The Supreme Court has ruled that information in your trash is "fair game" to anyone.  If confidential records in your possession are stolen, you are responsible.

The 1975 Federal Privacy Act was established to ensure government agencies protect the privacy of individuals and businesses with regard to information held by them and to hold these agencies liable if any information released without authorization.

Gramm-Leach-Bliley Act was created to ensure financial institutions protect the information of businesses and individuals and holds the institution accountable if private financial information is released.

FACTA requires the destruction of discarded consumer information.

HIPAA requires any medical institution to protect patients' privacy.  The institution is responsible for misused information.
